Facebook...Winklevoss twins lose appeal! Porn-loving 9th Circuit Judge Alex Kozinski rebuffs litigants!








The Social Network– an Oscar-winning flick - chronicled the launch of Facebook and the tawdry rags-to-riches tale about its founder and the legal wrangling that erupted in the courts thereafter on the heels of accusations that the cocky start-up maestro - Mark Zuckerberg - stole the original idea out-from-under former business partners Tyler and Cameron Winklevoss.

In my own review of the box-office hit, I underscored my sentiments.

The “idea” is the thing.

In the final analysis, a person who invented the “light bulb” is the genius, not the individual who imagined one in the shade of blue (to use an analogy).

In spite of that glaring reality, Zuckerberg vigorously argued to all within earshot - that without his expertise the Winklevoss pipe dream would never have gotten off-the-ground – let alone been transformed into a viable marketable enterprise on the competitive world-wide-web.

Like it or not, one glaring fact remains.

The Harvard “boys” - to the manor born with silver spoons in their mouth – were the true visionaries who hatched up the original concept (not Zuckerberg).

Undoubtedly - that’s why the anti-social (!) CEO relented - and agreed to give the two sticks-in-the-muds their due.

Consequently, an out-of-court settlement was proffered up for big bucks in favor of the dynamic duo.

End of story, right?

Not!

Shortly after Facebook took off on the Internet– and met with phenomenal success – the Winklevoss litigants did an about-face.

On the grounds that the stock was grossly overvalued when the settlement was - signed, sealed, and delivered - the poor sports elected to pursue the litigation with renewed vigor (no doubt emboldened by the “Social Network” movie script which appeared to validate their rip-off claims) with the ultimate aim of cashing-in for a bigger pay-off.

Yesterday, the grumblings of a disreputable Judge in the 9th Circuit Court of Appeal handed down a verdict - that was not only a stunner – but a  less than Judicial-sounding one!

“Tough Luck,” Chief bench warmer Alex Kozinski snapped without an ounce of compassion.

“The Winklevosses are sophisticated parties who were locked in a contentious struggle over ownership rights in one of the world’s fastest-growing companies,” he quipped in the court’s 3-0 ruling.

In part, the decision rested on evidence in the lower-court record which Kozinski stressed was legally-binding.

The controversial Judge was referring to a statement in the agreement that barred inclusion of any evidence gleened during a mediation session – including, but not limited to - misrepresentations about the value of the company stock.

“At some point litigation must come to an end,” Kozinski concluded.

This, from a Judge with dubious standing in the community-at-large - in legal circles, too - a “black sheep” who has demonstrated a nasty disregard for the rules (particularly when it pertains to his own inappropriate conduct).

California voters, lawyers, and Court Officials may recall that Judge (I use the term very loosely) Kozinski has been criticized in the past for frequenting web sites that exalt (and condone) sleazy pornography and for “downloading” disturbing erotic images to his laptop.

In addition, Kozinski has thumbed his nose at critics in the past - who lamented on the heels of the scandal - that it was highly improper (disgusting?) for a sitting Judge to flaunt his sexual perversions so publicly.

Meanwhile, in the other camp, the Winklevoss attorney has cried foul over the ruling.

According to Jerome Falk, Kozinski’s opinion raises “extremely significant questions of Federal Law” that deserve further legal scrutiny.

For good reason, a full review by the 9th Circuit may be on the horizon.

Dig a little deeper, Mr. Falk.

There may be a few greased palms involved, especially where the California court system is involved!

Roseanne Barr...exits Facebook It's all about me!









A dishy - silver-haired Roseanne Barr - has been turning up at book-signing gigs to affix her familiar "Joan Henry" to a spanking bullsh** tome on sale on bookshelves this week at top retailers around the country.

The mature look - some say a tad reminiscent of the one Diane Keaton sports like a comfortable old sensible shoe - suits the grand old dame of stand-up and sitcom comedy to a "t".

For the most part, Ms. Barr appears to be at peace with herself and the world.

Not with Facebook, however!

The racy comedienne - undisputed Queen of the snappy comeback - found the high-profile social hub a frustrating annoying experience.

"I thought I would join Facebook to keep my fans updated. But, the members on the site are only keen on chatting about themselves. They don't want to hear about me or what I have to say," she laughed cynically i so many words to a TV host during the course of an off-the-wall interview yesterday.

'Ya don't say!

Wasn't the much-ballyhooed tattooed lady hip to that fact (long before she logged on to become a member of the self-serving site) that the concept of  "Me, Myself, and I" reigns supreme?

The founders didn''t come up with the name - Facebook - for no good reason.

Indeed!

A web sight that focuses on "face" values is a losing proposition for intelligent sentient beings seeking like-minded souls (even a meaningful dialogue) in the overall scheme of things.

Mensa is more up your alley, Roseanne!

Facebook...Mark Zuckerberg & Social Network crosses privacy line! Again!



After catching a preview of the upcoming feature film "The Social Network" - which is the tawdry tale about the unscrupulous young entrepreneur who allegedly stole the idea for "Facebook" from his best friend in College - I've been pretty much decided that the folks were run the social hub are true scumbags.

For starters, the brass at the company - which is finally earning a profit hand-over-fist after many lean years (despite the networking giant's popularity) - don't give a damn about a member's right to privacy.

Indeed, in recent years, Facebook appears tobe the only company on the Internet facing widespread criticism on the issue.

Is the owner of Facebook (Mark Zuckerberg) really that clueless?

Or, does he just feign ignorance, in a deceitful effort to push the privacy limits?

What is obvious to most in respect to individual rights, fails to utter up a blip on the radar at Facebook headquarters.

In spite of continued protests - and bad press - Zuckerberg continues to slap  members in the face.

Recently, I have been hot under-the-collar over so-called security measures they implemented to ensure that individuals who check in from Wi-Fi hot spots around the Nation when they are on vacation or a business trip out-of-town - are "who" they allege they are with a right to access their account.

For instance, I encountered a lot of hooey when I attempted to log on from a cafe in San Francisco, in spite of the fact I inputted my correct ID and password.

Once the data was  keyed in, an unexpected pop-up dialogue informed me that since I was checking in from a location which was not my normal log-in site, they required that I identify "friends" circled in photographs "lifted" from my Facebook page.

As I noted in my previous post, Facebook proceeded to select images of "friends" of "friends" who I was not familiar with by "sight".

How was I expected to name a total stranger I never met before?

Needless to say, they were obviously embarrassed by the goof  - because they proceeded to not only ignore my e-mail communications - but the post as well.

However, at this juncture, the fishing expedition shifted into a more sinister mode.

When I attempted to log in today, for instance, Facebook offered up two options to verify my identity.

I could continue the process of photo identification (a waste of  valuable time) or input a code they would provide by e-mail or telephone call.

Say what?

Since I did not provide Facebook with any current land-line telephone number, my antennae suddenly went up.

Did the staff think that I wanted to be bothered on my personal phone line with such nonsense?

Needless to say, their latest attempt to intrude - and secure confidential contact information by deceitful surreptitious means - is highly suspect.

Why didn't they try to reach me by normal means - by e-mail communication - for instance?

It's never failed before!

Clearly, this was a diabolical ploy to obtain my private telephone number, so they could turn around and pass it out to - pushy advertisers, snake-oil salesmen, singles club floggers  - you name it.

Does Facebook honestly think that I have nothing better to do than answer telephone calls from  slimy bozos like that throughout the day and long into the night after the dishes from the supper hour have been stowed away?

Go fly a kite, Zucker!

Morphine...OMG! Don't mix with alcohol! Deadly potential...




Morphine potentially dangerous when mixed with alcohol!





In spite of all the sensational hoopla that tends to swirl around a celebrity when they get busted for a DUI - in tandem with a dose of prescription drugs - let's say - simple facts about the potential side effects of the interaction of the two are often left cloaked in intrigue and mystery.

Sometimes the end result may be a tragedy or two.

For example, even I invited a close-call the other night, when I threw caution to the oasis winds and headed out for a cocktail after it slipped my mind that a nurse gave me an injection of morphine just prior to my discharge at Sunrise Medical facility just earlier.

Suddenly, out-of-the-blue - as I delighted in a little action at the slot machines - blood rushed to my face as wobbly sailor's legs also gave the visual impression that I was slightly bombed to all of the other Casino guests in attendance at the midnight hour at the tony Hilton.

And, it was tough-going the following morning - when I found myself in a bit of a lingering stupor and struggling to haul ass out of my comfy bed - as I attempted to  locate an in-depth pamphlet on the subject of  drugs and their potential side effects.

OMG!

According to the manufacturers - inadvertently mixing morphine and alcohol was not only unwise - but potentially life-threatening.

No wonder I was nearly knocked on my a** unexpectedly as the romantic evening unfolded.

Needless to say, I expect to be more careful in the future when out for a night on the town.

Facebook...tracks log-in sites! Invasion of privacy...






If you're one of those gung-ho dudes anxious to hook up at a popular social hub - and inclined to fudge on your age - it may be wise to jot down the fake year you inputted for practical reasons.

For example, the other day when I started to log-in at Facebook, I was quite startled when a pop-up box notified me of a security alert.

In so many words, Facebook requested that I input my birthday, on the grounds that their server determined I was logging-in from a web site I never used before to access my homepage.

Fortunately, I was honest about my age when I signed up, so there was no problem providing the info in order to pass muster with Facebook's security protocol.

Frankly, though, I was a little put-off by the intrusion.

For starters, it ticked me off to learn that Facebook was monitoring (and storing) log-in checkpoints without my knowledge ('til now).

Notiwthstanding that practice - which I believe is in violation of my right to privacy - I find  the whole process inappropriate for a couple of reasons.

For starters, it was my understanding that the reason I was asked to select an ID and Password when I signed up at Facebook, was to guarantee access once I verified my identity by providing that information.

In addition, the request flew in the face of "logic", if you ask me.

For example, individuals with laptops tend to travel with their computers in tow - and therefore - are inclined to log in at various locations in one city or another where WiFi  services are provided by a myriad of carriers.

Duh!

I can only surmise at this juncture that Facebook must be experiencing some security breaches which have forced the company to be overly protective of their clients and the published home pages and profiles online.

To me, though, it smacks of  overkill.

Facebook is not Fort Knox, after all, just an entertaining place to mix and mingle now and then.

No more, no less.

Facebook, don't bother me needlessly.

Or, violate my right to check in from the WiFi location I choose, without scrutiny!

AFI Dallas...Britney Spears electrifies nightlife; celebrity brings out ugly side; Father of year is...


Britney breezes into dust bowl!

 


As the AFI shuttle bus turned the corner, we were suddenly swept up into a thong of trussed up teens heading off to the American Airlines Stadium to catch the Britney Spears concert.

In fact, Dallas fans felt so privileged to have the charismatic star in their midst, that all stops were pulled out in a bold-faced effort to sidle up and bask a little in the glow of her celebrated light.

A ticket - whether it be for a whopping $2000 in the front-row-seat - or tagged at a paltry $150 up in the boondocks - was definitely an entree into an exclusive social set many were pining for if only for one night.

Unfortunately, a few ugly personality traits reared their head, as the scenario unfolded before me.

Ah, fame and celebrity bring out the worst in people.

For example, one AFI photographer, had been quite congenial and buddy-buddy with his fellow paparazzi (even inclined to glad-hand all the AFI staff and guests when he made his round through the Festival lounges and red carpet events each day) up 'til last evening.

When he caught wind of a chi-chi party Ms. Spears may be attending, he surreptitiously slipped out a back door so he could crash it on the sly with the specific intention of getting a jump on exclusive publicity stills.

Tsk! Tsk!

In contrast, one local sportscaster landed the glorious honor of "Father of the year in" in my eyes, when he generously gave up his ticket to ensure his 14 year-old-daughter could party it up in the Fox Network suite (center row at the high-energy concert) with her best friend as when Britney strutted her stuff on the welcoming Dallas stage.

Moi?

Well, there wasn't any intense desire to follow the madding crowd.

After all, at a party hosted by CineVegas last year, I was able to mix-and-mingle with Ms. Spears when she quietly slipped in unnoticed by fans and the paparazzi.

The classy sophisticated party-goers in attendance barely batted-an-eye and left the - at times, harried pop chanteuse - alone.

Some people have impeccable manners, you know!
